The Mandatory Outsourcing Rule for Vacation Rental Management: What You Need to Know First

The requirement to outsource management to a registered vacation rental management company is set out in Article 11 of the Private Lodging Business Act (Japan’s “Minpaku Law”). For “unhosted” properties—where the owner does not live on-site—outsourcing management to a registered company is a legal obligation, not an option. We regularly see owners who assumed they could run their property themselves stumble at the application stage because they overlooked this requirement. Correctly determining whether this obligation applies to your property is the starting point for lawful operation.

When Outsourcing Is Required—and When It Isn’t

Under the Private Lodging Business Act, if the owner (the registered private lodging business operator) does not “reside” at the property while guests are staying there, they are required to outsource management duties to a vacation rental management company registered with the Minister of Land, Infrastructure, Transport and Tourism.

The precise definition of “residing” is addressed in guidelines issued by the Japan Tourism Agency, but in practice, the key question is simple: is the owner living on-site together with guests during their stay? If you’re renting out a spare room in your own home (a “hosted” setup), no outsourcing obligation applies. But if you’re renting out a condo unit for guest use while living elsewhere yourself, that’s considered “unhosted,” and outsourcing becomes mandatory. This is the situation most owners who hold rental properties purely as investments find themselves in.

What Only a Registered Management Company Can Legally Do

The company you outsource to must be a “vacation rental management company” officially registered with the Minister of Land, Infrastructure, Transport and Tourism. Handing everything over to an unregistered cleaning company or general property manager does not satisfy this legal obligation, no matter how capable they may be. The management duties defined under the Private Lodging Business Act include guest support, facility maintenance, hygiene management, and handling noise complaints and other issues with neighbors.

When we take over a property from an owner, we sometimes find that the previous arrangement involved “a real estate agent acquaintance who wasn’t actually a registered company.” This kind of setup can constitute a violation of the registration requirements, carrying the risk of administrative guidance—or, in the worst case, revocation of the property’s registration. Checking for a valid registration certificate is one of the very first things our team does on day one of any handover.

7 Things to Check Before Choosing a Management Company

1. Registration Number

Verify the company’s registration number to confirm it is officially registered with the Minister of Land, Infrastructure, Transport and Tourism. You can cross-check this number against public disclosures from the Japan Tourism Agency on the implementation status of the Private Lodging Business Act, or against the registered operator list published by the Ministry. A verbal “we’re registered” isn’t sufficient—always ask to see the number.

2. Coverage Area and Property Types

Some management companies only operate in specific metropolitan areas, or specialize exclusively in single condo units. Be sure to confirm their track record with the type of property you own—whether that’s a detached house, multiple properties, or a property in a regional area.

3. Emergency and Late-Night Response

Guest issues don’t follow business hours. Ask specifically who responds, how quickly, and how—for a late-night lockout, equipment failure, or a noise complaint from neighbors. Some companies advertise “24-hour support” but only offer phone reception, with no one actually able to go to the property in person.

4. Cleaning and Linen Logistics

Post-checkout cleaning is one of the most critical operations affecting guest experience and property quality. It’s not unusual in this industry to hear of bookings being paused because a company couldn’t secure enough cleaning staff during peak season. Don’t just ask whether cleaning is handled in-house or outsourced—ask specifically how they secure staffing during high-demand periods.

5. Pricing and Revenue Management Approach

Who sets your nightly rates on OTAs like Airbnb, and how, has a direct impact on your bottom line. A company that sets a fixed price and leaves it unchanged will typically see very different occupancy and revenue results compared to one that adjusts pricing daily based on demand forecasting—the gap can be substantial depending on location and season. Ask what tools they use and how often they review pricing.

6. Frequency and Depth of Reporting

There’s a world of difference between a company that only sends a monthly revenue summary and one that shares occupancy rates, review content, complaint logs, and neighbor interaction records. This directly affects how well you, as the owner, can stay on top of your property’s status. We recommend asking to see a sample report before signing on.

7. Termination Terms and Handover Process

Always confirm the notice period and any penalty fees for ending the contract. Just as important: what happens to your OTA account and review history after termination? This is a crucial practical issue when switching to a new management company. Whether the account is registered under the owner’s name or the management company’s name makes a huge difference in how smooth that transition will be.
